Obama to the nation: Rekindle post-Sept. 11 unity (AP)

WASHINGTON ? President Barack Obama is calling on Americans to rekindle the spirit of unity that characterized the response to the Sept. 11 attacks. "It can be a lasting virtue," he said. "Not just on one day, but every day."

The president made his appeal during his weekly radio and Internet address, two weeks before the 10th anniversary of the al-Qaida plot that turned commercial jetliners into deadly weapons in New York, Pennsylvania and northern Virginia.

Obama plans to observe the anniversary on Sept. 11 with stops at ground zero in lower Manhattan, where the World Trade Center towers fell; at Shanksville, Pa., where one of the commandeered planes crashed; and at the Pentagon, which was also hit by a hijacked jetliner.

But he cast his plea for good will against the backdrop of the economic challenges facing the country today. Coming in the aftermath of bitter partisan fights over government spending and tough criticism of his administration by Republican presidential candidates, his remarks were an overt call for greater cooperation.

"Even the smallest act of service, the simplest act of kindness, is a way to honor those we lost, a way to reclaim that spirit of unity that followed 9/11," he said.

He recalled the work of volunteers following the attacks, the blood donations and the food and clothing drives.

"We were united, and the outpouring of generosity and compassion reminded us that in times of challenge, we Americans move forward together, as one people," he said.

These days, he said, the country is still fighting al-Qaida, it is ending the war in Iraq, pulling back troops from Afghanistan and "emerging from the worst economic crisis in our lifetimes."

"None of this will be easy," he said. "And it can't be the work of government alone. As we saw after 9/11, the strength of America has always been the character and compassion of our people.

"So as we mark this solemn anniversary, let's summon that spirit once more. And let's show that the sense of common purpose that we need in America doesn't have to be a fleeting moment; it can be a lasting virtue ? not just on one day, but every day."

In the Republican address, Sen. Dean Heller of Nevada stuck to economic themes, criticizing the Obama administration for creating "more government that continues to impede economic growth at every turn."

"To paraphrase one of the business leaders in my state, this president and his policies have been a big wet blanket on our economy," he said.

Heller called for a balanced budget amendment to the Constitution and repeal of the health care law that Obama signed last year, both demands that Republicans have failed to achieve.

He also called for an overhaul of Social Security and Medicare to reduce their long-term costs and to simplify tax laws.

The Urban Land Conservancy (ULC) purchased its fifth property for $1.35 million using Denver?s Transit-Oriented Development (TOD) Fund on Tuesday, a unique fund specifically set up with ULC, Enterprise Community Partners, City and County of Denver and other investors, to acquire and preserve land for workforce housing near light rail stops and high frequency bus routes.

Villa TOD Apartments is a mixed-use property located at 900 to 926 W. 10th Avenue, in the heart of the Santa Fe Arts District and includes 16 units of affordable apartments, four commercial office spaces and an auto body shop. Built in the 1920s, this .31 acre site is within five blocks of the Osage Light Rail Station located at 10th Avenue and Osage Street.

?The preservation and structural improvement of Villa TOD will boost the health of the neighborhood by providing workforce housing, affordable office space for neighborhood programs and will create local jobs,? said Aaron Miripol, President and CEO of ULC.

Feds approve key expansion of NM nuclear plant

ALBUQUERQUE, N.M. (AP) ? A federal commission announced approval Wednesday for a uranium enrichment plant in southeastern New Mexico to begin operating more of its massive processing system, which would double the facility's capacity to process nuclear fuel.

The U.S. Nuclear Regulatory Commission has authorized Urenco USA and subsidiary Louisiana Energy Services to bring online two additional sequential enrichment systems, known as cascades. Although Urenco is tightlipped about its technology and its customers, the enriched uranium it produces can be used to supply fuel for nuclear power plants domestically and overseas.

It is a key expansion for the facility that opened last summer, when the nuclear commission's authorization made it the first major nuclear facility licensed in the U.S. in three decades.

Urenco spokesman Don Johnson said the company is thrilled. "Cascades 1 and 2 have been spinning and producing all along and our focus remains, as it has always been, on bringing new cascades online to join them."

Employees began loading uranium stock into the newly authorized cascades Wednesday, and officials expected both to be running within a few days.

The cascades, made up of numerous high-tech centrifuges, are central to the way the plant near Eunice enriches uranium. The process employs an elaborate network of pipes, electrical systems and sensors in sterile, gymnasium-sized halls.

Uranium, in its natural state, doesn't contain enough of a particular nuclear isotope to work as fuel in certain power plants. The enrichment process can greatly boost the necessary isotope concentration.

Authorization for the two additional cascades followed nuclear commission inspections earlier this year. The agency said in a statement that the inspections provided reasonable assurance that the design, construction and use of safety items will "protect against natural phenomena and the consequences of potential accidents."

The agency inspectors looked at everything from paper receipts to the steel works that connect the centrifuges inside the cascade halls. They also interviewed employees and contractors.

About 350 employees work at the plant, along with another 700 construction workers.

The work force is expected to remain stable for the foreseeable future despite the authorization and the start-up of the two cascades, Johnson said.

However, the company is considering another expansion that would again double the plant's capacity. Funding is available for design and other preliminary studies, but Johnson said federal approval would be needed to build on to the plant.

In a region where pump jacks dot the landscape and oil field service trucks keep the road hot, elected officials have been anxiously watching the Urenco plant grow. They see it as a key element in Lea County's effort to diversify its economy beyond the boom-and-bust cycle of oil and natural gas development.

Last year, the county rebranded itself as the EnergyPlex, a place where everything from oil and natural gas to nuclear and renewable energy has been welcomed.

Dividends are already being paid in the form of jobs, new housing and businesses, and additional tax revenue.

New companies are also looking to locate in the region. One of them is Idaho-based International Isotopes Inc., which plans to build a nuclear facility west of Hobbs.

Louisiana Energy Services and International Isotopes agreed last year that International Isotopes would provide uranium deconversion services for the enrichment plant.

International Isotopes plans to use its proposed facility to deconvert the depleted uranium tails that result from the enrichment process. It would also simultaneously extract fluorine gases that could be sold for use in manufacturing solar panels and medical equipment.

International Isotopes announced Wednesday that it now holds title to 640 acres about 25 miles from the enrichment plant following a land transfer agreement with the state and the Economic Development Corp. of Lea County. The company plans to use about 40 of the acres to build its plant once licensed by the nuclear commission.

WASHINGTON ? Another recession isn't likely over the next 12 months. Neither is any meaningful improvement in the economy.

That's the picture that emerges from an Associated Press survey of leading economists who have grown more pessimistic in recent weeks. They say high unemployment and weak consumer spending will hold back the U.S. economy into 2012.

Their gloominess comes at a time when Europe's debt crisis threatens to infect the global financial system. It also coincides with an annual economic conference late this week in Jackson Hole, Wyo., and speculation about whether Federal Reserve Chairman Ben Bernanke will unveil any new steps there to help the economy.

Worries that another recession is nearing and that the European crisis will spread have led to a roughly 15 percent drop in stock prices in the past month. Economists say the Great Recession ended in June 2009.

What makes a solution so difficult is that the fear gripping investors isn't just a symptom of economic distress; it's also a cause of it. Sinking stock prices frighten consumers and businesses. They then spend and invest less. Investors respond to lower corporate sales by selling stocks, worsening the market declines.

Each day that the stock market sinks "puts another nail in the coffin of the recovery," says Beth Ann Bovino, senior economist at Standard & Poor's.

"I had been saying it was a half-speed recovery; now, it's a quarter-speed recovery," Bovino says.

She is among 43 private, corporate and academic economists surveyed this month by the AP. As a group, they are more downbeat than when surveyed eight weeks ago. Among their conclusions:

? The likelihood of a recession within the next 12 months is 26 percent. In June, the economists had put the likelihood at 15 percent.

? The economy will inch ahead at an annual rate of 2 percent in the July-September quarter and 2.2 percent from October through December. Though stronger than the growth for the first half of 2011, that isn't enough to lower the unemployment rate much, if at all. And next year will barely be stronger.

? Weak consumer spending poses a "major" risk to the economy. In June, Americans cut their spending for the first time in nearly two years. And consumer spending fuels about 70 percent of the economy.

? The unemployment rate will end this year at 9 percent and 2012 at 8.5 percent. Those rates are slightly less than July's 9.1 percent. But they're more consistent with a recession than a recovery.

? The Fed's efforts to keep interest rates at record lows may not succeed in promoting growth or easing unemployment. But its low-rate policies will likely boost stock prices.

The economists do foresee economic growth, job creation, consumer spending and home prices all rising over the next year. But the gains they expect are so slight that many Americans won't notice.

For months, the Fed and private economists had clung to hopes that a slowdown in spring and early summer would prove temporary. They initially blamed temporary factors ? especially higher oil prices and an earthquake and nuclear crisis in Japan that disrupted factory production.

But the economy has kept worsening. U.S. home prices remain depressed. Job growth is weak. Workers' pay is barely rising. The economy grew at an annual rate of just 0.8 percent in the first half of 2011 ? much less than expected.

The benefits of the government's $862 billion stimulus are fading. No more stimulus is likely. And in June, the Fed ended a $600 billion Treasury bond-buying program that was designed to help keep rates low to spur spending and increase stock prices.

Then Europe's intensifying debt crisis and Congress' standoff over raising the debt ceiling undermined consumer confidence and spooked the markets. Consumers and investors foresee more gridlock ahead as a congressional committee seeks ways to cut at least $1.2 trillion in debt.

That means government spending, which normally helps economies climb back from recessions, will likely instead restrain growth.

Earlier this month, the Fed pledged to keep short-term rates near zero until mid-2013 if necessary to combat economic weakness. The Fed also seemed to suggest it might be open to another round of bond purchases.

Many are waiting with anticipation for Bernanke's speech Friday in Jackson Hole at a conference held by the Federal Reserve Bank of Kansas City. At last year's conference, Bernanke set the stage for the Fed's $600 billion Treasury-buying program.

But the economists in the AP survey are skeptical of the Fed's ability to improve economic conditions substantially.

"The Fed can't do anything at this stage that's going to be meaningful," says Joshua Shapiro, chief U.S. economist at MFR Inc.

The Fed can influence interest rates, Shapiro noted, but "the level of interest rates is not the impediment to growth."

A bigger obstacle is tepid demand across the economy. And even with rates at record lows, many companies and consumers can't or won't borrow. Consumers don't want to take on more debt while the economic outlook remains so dim and their job security uncertain.

The collapse in home prices means households have lost $7 trillion in equity since 2005. They're saving, not spending, to try to rebuild their lost wealth, says Sean Snaith, director of the University of Central Florida's Institute for Economic Competitiveness.

Consumers have shed about $240 billion in debt, excluding real estate loans, since the end of 2008, according to the Federal Reserve Bank of New York.

"We need to see the housing market stabilize," Snaith says. "We need to see some job creation. Until then, consumers are trying to put nest eggs that turned into Humpty Dumpty back together again ... It's just going to take time."

American Grant Writing: Race Matters

One of the problems with affirmative action "getting them into the school" is that it can get them into schools that are above their intellectual level or competitive beyond what they're prepared for.

This is not any statement about any particular group's intelligence. This is about INDIVIDUAL intelligence. For instance, I (a white person) may not be cut out for Harvard Law School. Perhaps I should go to Cincinnati instead, because I'm more likely to succeed. (Cincinnati is a good law school, BTW.) If I went to Harvard, I'd probably break under the pressure and drop out, and a career councelor would do well to raise this issue to me. Now, let's consider a black person of intelligence equal to mine. If affirmative action helped them inappropriately get into Hardvard Law, then affirmative action has just DECREASED their chances of success!

That would be bad. Bad for that person, bad for our culture's progress towards equal rights, bad for our culture's perception of minorities and their capabilities, etc. (Being a minority doesn't make one more likely to be less intelligent, and unfortunately, some bigots need to have that fact reinforced regularly.) What we want is to give everyone an equal opportunity to SUCCEED, and to a certain extent, that involves placing them in the school where they are challenged appropriately, will learn best, and are most likely to succeed, IF THEY WORK HARD.

People are gifted with whatever intelligence they were born with, also affected by upbringing and primary education. This is not a basis on which to JUDGE people in terms of their human value so much as an attribute that varies from one person to another and which affects what they are capable of conceiving of intellectually. On the other hand, WORK ETHIC, is something that everyone should learn, and if you don't learn it, you are more likely to fail, and that is your fault if you do. If you are willing to WORK, then there is SOME job out there that you can do well at and succeed in. Our objective should be appropriate placement. Now, if someone decides that they want to go to a school that is above or below our recommendation, that is their choice. Our recommendation can be wrong, because we can incorrectly evaluate people. But that is a different matter.

The fact is, most people, regardless of race or any other attribute, would not do well in Harvard Law School.

More likely than an intelligence issue, the reason many people of lower socio-economic classes may fail at a place like Harvard is that they simply have not learned the sort of competitiveness and intellectual strategies that more affluent people perhaps tend to be exposed to in early life. (Of course, you also get your share of rich brats who are equally ignorant.) This is an issue of preparation, not smarts. Someone from a rich family in Boston may need an IQ of 115 to get through Harvard Law, in part because their parents are lawyers who have prepared their children for all the gotchas that happen in law school. Someone from the back waters of Appalacia may need an IQ of 125 to get through Harvard Law, simply because they have to do a whole hell of a lot more learning and adapting on the fly while they are there. Inner-city blacks are in the same boat as the back-water Appalacians. However, if the undereducated go to Cincinnati instead, they will succeed, and moreover, they will be able to impart to their children (who inherit the same genes, so it's not a racial issue) the knowledge necessary to succeed at Harvard.

Also, I need to make the obligatory comments about race. Race, as we perceive it, is based mostly on superficial factors like skin color. Africans, South Indians, etc. are brown because there's more sun in the place they're adapted to. Europeans are pink because there's less sun. You can do your own research on the relationship between UV, vitamin D, skin cancer, birth defects, etc. However, humans haven't been out of Africa long enough to evolve any really significant differences. To what extent can the structure and processes of criminal justice, be said to represent a system?

INTRODUCTION:

Structure and processes of criminal justice are very complex.? In order to deal appropriately with potential or existing criminal activity different procedures and processes are involved.?? In this essay, I will explain the criminal justice system to the extent of its structure and processes, creating a mental image to show how the criminal justice system is working and represented.

CRIMINAL JUSTICE:

Criminal justice; can be described as the study of the theories and practices of the law courts, the police as well as the institutions of rehabilitation.

Criminal justice can also be defined as the process used by states or governments through? legislation, organisation, and practice geared towards the maintenance of control within human societies(social control), the prevention and control of violent behaviours or crime, the prosecution, sanctioning or imprisonment of those who are involved in crime(law violators).

When dealing with accused persons or groups of persons through the system of criminal justice the government is usually charged with the responsibility of working within the laid down framework of the constitution through the laws that are set up to protect human rights.

Criminal justice is a multi disciplinary field that encompasses the process of reviews, discussions, relationships and processes associated with the criminal justice system.

In addition to this, criminal justice does also examine the legal framework or system within the broad psychological and socio-political framework and goes ahead to explore how this so said framework influence the actions, activities and actors of the criminal justice system.

HISTORY OF CRIMINAL JUSTICE:

The system of criminal justice has been an evolving system since ancient times. Within this process, new ways of finding evidence, sentencing and punishment have developed over time. Likewise, some methods that were in use before for punishing and or convicting have been abandoned or rendered un-ethical. These changes have been pre-eminence by factors like increasing political reforms worldwide. In addition, other social, economic and political factors have also prompted these changes. Some of these factors include changing cultures and customs, modernisation or the changes brought about by economic advancement as well as changing political systems.

THE CRIMINAL JUSTICE SYSTEM OF ENGLAND AND WALES:

The criminal justice system of England and Wales is one of the most influential departments of the public service. Within its operations the criminal justice system is? governed through some specialised agencies including the ?national offender management service? and the department of corrections-which administers judgement on guilty persons, the law courts-which try and impose judgement on law breakers, ?the crown prosecution service?, and the police service- which arrest those involved in criminal activities.

Within the country the work of these agencies are supervised by three departments of the government, which are The Attorney Generals Office, The Ministry of Justice, and The Home Office.

These agencies and departments work together in a symbiotic manner in order to achieve the following objectives geared towards improving the system of criminal justice.

The prevention and detection of criminal activities:

Provide victims of crime as well as the witnesses involved in legal procedures moral and psychological support.

The punishment and the provision of rehabilitation facilities to crime offenders

In order to achieve their objectives the assistance of the Local Criminal Justice Boards is necessary. The local criminal justice boards usually prioritise areas for reducing crime within the different regions by administering regional justice. The local criminal justice boards are usually charged with the following de-regulated tasks:

Improving without discrimination, the process of delivery of justice to all persons.

The local criminal justice boards are also charged with the task of improving the quality of service provided to witnesses and victims of criminal actions.

These boards are also charged with the role of improving and advancing the level of public confidence in the system of criminal justice.

The existing legal system in England and Wales is usually Adversarial in all law courts. This application is applied even in the juvenile courts.? According to this system, the side of prosecution is required by law to disclose all relevant information pertaining to a case to the defence. This requirement however on the part of the defence is not existent.

In England and Wales, there are many ways of classifying crime. In most cases, the classification of crimes is usually based on the seriousness or the gravity of the crime. In addition, the classification may be based on the procedure used in bringing the case to trial or before a judge. For example in a magistrate?s court, a case may only be brought forward through a system of indictment. In addition, the case may be classified according to the availability of what is called the sanction of imprisonment. A crime may also be classified in terms of the department of home office?s standard list of serious crimes.

The current age of criminal responsibility in both England and Wales is ten. Regardless of this fact, any person between the age of ten and seventeen is usually brought to a youth court when they are charged with a criminal offence. Additionally sanctions available to the youth courts are inherently more restricted as compared to the sanctions imposed in adult courts. The major difference between the two? is that while an adult charged in an adult court will have to bear the full cost of the sanction, a child or a person charged in a youth court can be imposed a fine which the parents are supposed to pay. In addition, a person under the age of 18 may be imposed supervision or attendance centre orders.

The structure and processes of the criminal justice in England and Wales can be said to constitute a system since every aspect of the system of the criminal justice is clearly documented and all actions pertaining to a trial are well known.

Through this system, if the police (law enforcement) wish to bring a person to trial or prosecution then they are supposed to charge the defendant and hand the necessary case papers to The Crown Prosecution Service.

The Crown Prosecution Service is supposed to conduct a review of the evidence submitted and makes an informed decision of whether there is need to prosecute or not. If the evidence provided is not viewed as sufficient to prosecute then The Crown Prosecution Service may fail to prosecute.

Despite all of these systems, the accused is also provided some rights.? Among these rights, include the right to legal advice. The accused is also entitled to legal assistance when he/she is facing a murder charge. Additionally, if the prosecution appeals to the House of Lords, the defendant can be granted legal aid.

Within the judicial system, an accused is supposed to be forwarded to a court of first instance (the magistrate?s courts). Once a case is brought to the magistrate?s court, the court has to decide whether the case is suitable to be tried in that court and or whether the warring parties has consented to the case being tried in the court.

CONCLUSION:

The system of criminal justice is one of the most specialized within England and Wales. Despite its drawbacks, the system has with stood the test of time and it will most probably advance with the progression of globalisation.
