Jackson death trial opens with grim photos, drug use (Reuters)

LOS ANGELES (Reuters) ? Grim photos of Michael Jackson lying dead in a hospital bed juxtaposed with a picture of the "Thriller" singer rehearsing the day before his demise brought an emotional opening on Tuesday to the manslaughter trial of the doctor hired to care for him.

In opening arguments two years after Jackson's sudden death by drug overdose, prosecutor David Walgren told jurors that the pop star "literally put his life in the hands of Dr. Conrad Murray."

"That misplaced trust in the hands of Conrad Murray cost Michael Jackson his life," Walgren added.

But Murray's lawyers argued that Jackson "caused his own death" by giving himself extra medication. "He died so rapidly, so instantly, he didn't even have time to close his eyes," defense attorney Ed Chernoff said in opening arguments.

Murray has pleaded not guilty to the involuntary manslaughter of Jackson on June 25, 2009, but faces a prison sentence of up to four years if jurors find he is ultimately responsible for the pop star's death due to inadequate care. The trial is expected to last four to six weeks.

The Texas cardiologist, who was getting $150,000 a month to care for Jackson, wiped away tears during Tuesday's opening statements as attorney Chernoff defended him.

Jackson's lifeless body was found at his rented Los Angeles mansion just three weeks before a series of 50 planned London comeback concerts titled "This Is It" were scheduled to begin.

Murray has admitted giving the 50 year-old pop star a dose of the powerful anesthetic propofol as a sleeping aid while he rehearsed for the shows. But Chernoff told jurors Murray was trying to wean the pop star off his addiction to the drug, which Jackson called his "milk."

Tired, weary of rehearsing, and under pressure to get the concerts ready, a frustrated Jackson gave himself eight lorazepam anti-anxiety pills in a bid to sleep in the early hours of June 25, 2009, Chernoff said.

"PERFECT STORM"

"We believe the evidence will show. ... that when Dr. Murray left the room, Michael Jackson self-administered a dose of propofol that with the lorazepam created a perfect storm within his body that killed him instantly," Chernoff added.

Jackson's parents, Joe and Katherine, his sisters, Janet and La Toya, and other family members were in court on Tuesday, while outside dozens of fans outside the courtroom held sunflowers, pictures of the dead pop star, and placards saying "Justice for Michael."

Walgren opened the prosecution case by showing jurors a photo of a thin Jackson lying dead on a hospital gurney, side by side with a picture of him singing and dancing while rehearsing for the concerts one day before. Footage of the rehearsals were made into Jackson's posthumous concert movie "This Is It" in 2009, that became a global box office hit.

But Chernoff painted a different scenario, claiming that Jackson was under huge pressure to make the concerts -- his first in 10 years -- a success, not just financially but also to restore his image after his damaging 2005 trial and acquittal for child molestation.

Jurors are expected to hear testimony from the paramedics who transported Jackson to the hospital, medical experts, Jackson's choreographer and Murray's girlfriends.

The first prosecution witness is expected to be Kenny Ortega, the choreographer and film director who was hired to stage the London shows and who was conducting rehearsals with Jackson in Los Angeles.

Metro spends nearly $40k on communications office upgrades ...

Metro's communications staff has seen a lot of changes in recent months, and so has their office space.

The agency has spent nearly $40,000 revamping the office space for its public relations team, including adding new carpet, a new couch and new Apple computers, according to a spokeswoman.

General Manager Richard Sarles brought in a whole new team to brand his work at Metro since joining the agency last year, with new employees from the top on down. He even created a few new positions, including a social media guru, a market researcher and a managing director of public relations. The new managing director also needed an assistant. More hires are expected soon as the agency creates a bus alert system with three new people.

With those staffing changes came changes to the office space. The agency had to squeeze two more offices into the existing space at Metro's headquarters, said Lynn Bowersox, managing director of public relations.

That meant taking down moveable metal walls, then replacing 10-year-old carpet squares, she said. The agency did get some furniture from storage to fill the new offices, she said, but bought a new sofa and two new chairs for the office's common area.

Bowersox estimated the reconfiguration and furniture cost just under $30,000.

And the department bought three Apple computers and monitors for approximately $9,875, she said.

"These expenses were covered within our existing budget for the department and provide the space and tools we need to improve communications with our customers, stakeholders and employees," Bowersox wrote in an email.

UBS's new CEO commits to keeping U.S. brokerage (Reuters)

NEW YORK (Reuters) ? UBS AG's (UBSN.VX)top two executives reassured the company's U.S. brokers and advisers on Monday that the embattled Swiss banking giant has no plans to sell UBS Wealth Management Americas.

"Again: this business is not for sale," UBS Chairman Kasper Villiger and interim CEO Sergio Ermotti wrote in an internal memo. Ermotti was installed as CEO over the weekend after the sudden departure of group chief executive Oswald Gruebel, a strong backer of the U.S. business.

Villiger and Ermotti also affirmed their support for the Wealth Management Americas CEO Robert McCann, a former Merrill Lynch executive hired two years ago to lead the U.S. unit's turnaround.

"UBS is committed to further developing our franchise in this important wealth market under Bob's leadership," Villiger and Ermotti wrote. A successful U.S. wealth management business is "essential" to the bank's strategy, they said.

Gruebel's resignation after a $2.3 billion trading loss from an alleged rogue trader adds to a drumbeat of disturbing headlines over the past three years that has undermined confidence among U.S. clients and financial advisers, some advisers and headhunters said.

The rogue trading incident uncovered by the bank two weeks ago undermined two years of efforts by Gruebel, a former Credit Suisse executive, to staunch billions of dollars of trading losses that eroded confidence in the parent bank during the 2008 financial crisis.

In the U.S., the latest scandal is putting brokers once again on the defensive in fending off questions from wealthy clients. UBS employed almost 6,900 financial advisers at the end of the second quarter, less than half the total of industry leader Morgan Stanley (MS.N).

"A lot of the advisers have been telling us that this negative press was really hard to spin," said Mindy Diamond, a headhunter at Diamond Consultants in Chester, New Jersey, who has hired brokers away from UBS. "There are a lot of very frustrated UBS advisers."

Rick Peterson, a recruiter in Houston who seeks to hire out of UBS, said the sense of instability among the firm's advisers is growing.

"Every time you hear, 'UBS loses a pile of money' or 'UBS is in trouble with the U.S. government,' it means UBS is in trouble with their clients," he said.

SALE TALK

The trading loss and Gruebel's departure also has breathed new life into a long-standing rumor that UBS would divest or spin off its U.S. brokerage arm, which is not as profitable as the Swiss company's private banking businesses.

McCann's brokerage operation pays advisers a percentage of fees and commissions, which often results in higher payouts than the salaries and bonuses received by private bankers. A broker's clients also can be more loyal to a broker than to the parent bank, while private banking has the reverse dynamic.

UBS earlier this year was rumored to be talking about selling the U.S. brokerage to Wells Fargo & Co (WFC.N) big U.S. bank that has been expanding its brokerage arm. A few years ago, HSBC Holdings PLC (HSBA.L) was the purported suitor.

Wells, HSBC and UBS declined at the times to comment on the speculation.

Before he joined the firm, McCann himself was part of a group that approached Gruebel to buy the U.S. operation, and rumors of a management buyout has resurfaced recently. UBS said the rumor was "categorically untrue."

Research analyst Richard Bove of Rochdale Securities said UBS executives in Switzerland have good reason to hold onto the U.S. business as they struggle to build capital and restructure their investment bank.

"The U.S. brokerage is not capital intensive and it throws off cash," Bove said.

UBS executives on Monday, nevertheless, took pains to combat rumors within the bank that with Gruebel gone the emphasis should turn to private banking.

Robert Mulholland, the No. 2 executive at UBS Wealth Management Americas, reinforced Villiger and Ermotti's message in a conference call with regional and branch managers Monday morning.

"We are not for sale," he said, according to a UBS employee who listened to the call. "It was the board's decision not to sell, not just Ossie's."

The impact of Gruebel's departure, he added, is "in a word, nothing."

However, some advisers indicated that the latest scandal may be the last straw following a tax scandal in which UBS reached a $780 million settlement with the U.S. government over helping U.S. clients avoid paying almost $20 billion of taxes by setting up offshore accounts. The bank also agreed to turn over the name of 4,450 clients that U.S. officials suspect of tax evasion.

In the year before McCann arrived near the end of 2009, nearly a third of top advisers bolted and client assets plunged by about $119 billion. McCann had been reversing that trend prior to the latest trading scandal.

Now the tough conversations have returned.

"I had a client ask me, 'How can I trust you to manage my money, if you can't manage yours," said a veteran UBS broker, who asked not to be named. "There's a serious lack of confidence in the firm. There's constant surprises."

Amsterdam, The Netherlands: People who cycle through London and other major cities have higher levels of black carbon in their airway cells, experts from the UK have shown.

The research, which will be presented at the European Respiratory Society's Annual Congress in Amsterdam today (25 September 2011), suggests that cyclists inhale more black carbon than pedestrians, which may cause damage to the lungs.

The combustion of fossil fuels results in the generation of large numbers of inhalable particles of soot (black carbon). There is increasing evidence that inhalation of black carbon particles is associated with a wide range of health effects - including heart attacks and reduced lung function.

The researchers, led by Professor Jonathan Grigg from Barts and the London School of Medicine, aimed to identify whether the way healthy adults commute to work affects their exposure to black carbon. Specifically, they tested the hypothesis that cyclists have higher personal exposure to black carbon.

To test this theory the study compared the lung dose of black carbon in cyclists and pedestrians. To measure lung dose the researchers sampled a lower airway cell called the airway macrophage - a specialised cell that sits on the airway surface and ingests foreign material.

The researchers collected sputum samples from five adults who regularly cycled to work in London and five pedestrians and analysed the amount of black carbon found in their airway macrophages. All participants in the study were non-smoking healthy urban commuters aged between 18 and 40 yrs.

The results showed that in this small sample, cyclists have 2.3-times more black carbon in their lungs when compared with pedestrians. The probability that this difference occurred by chance is less than 1 in 100.

Dr Chinedu Nwokoro, one of the researchers of the study and an active cyclist, said: "The results of this study have shown that cycling in a large European city increases exposure to black carbon. This could be due to a number of factors including the fact that cyclists breathe more deeply and at a quicker rate than pedestrians while in closer proximity to exhaust fumes, which could increase the number of airborne particles penetrating the lungs. Our data strongly suggest that personal exposure to black carbon should be considered when planning cycling routes. Whether cycling by healthy individuals is in itself associated with adverse health effects is currently being assessed in a larger ongoing study."

In August the company lowered its outlook, saying it expects adjusted earnings of as much as $4.86 per share and revenue of as much as $127.6 billion, both of which were below analyst projections. The proposed spinoff of the PC division could make matters worse as customers refrain from ordering until a buyer is found.

Deliberations among the company's board of directors, which leaked Wednesday in published reports, also signal the disarray within HP about its direction. Shareholders have already voiced their fears. HP's market value has fallen by $60 billion since former CEO Mark Hurd was forced out in August of last year over an ethical scandal. If Apotheker is ousted, he will be the third CEO jettisoned from HP in the past six years.

It won't be the first time for Apotheker, who was forced out of his previous job as CEO of business software maker SAP AG over ill-timed price hikes he implemented and widespread employee dissatisfaction. Apotheker was supposed to be a steady hand to steer HP out of controversy. Many analysts mocked the pick as an unusual choice, considering the circumstances.

In some ways, Meg Whitman would be an odd choice to replace Apotheker. While Whitman is more of a celebrity, her record wasn't perfect at eBay. She resigned from eBay in 2008 amid slowing growth and disappointment over eBay's $2.6 billion gamble on the Skype Internet phone service. She's a billionaire who spent more than any candidate for a statewide office in U.S. history in unsuccessful Republican campaign for California governor last year. She spent at least $174 million, all but $30 million of it her own money.

Still, Whitman spent a decade guiding eBay and is a widely respected executive who took a website with 30 employees and $86 million in revenue and turned it into corporation with 15,000 people and nearly $6 billion in revenue. Whitman is among the people brought onto HP's board in a reshuffling shortly after Apotheker was hired. How she would fare as CEO amid HP's current restructuring is unclear.

Apotheker has struggled, while complaining that HP suffered years of under-investment by his predecessor, Mark Hurd.

Reaction to his latest decision to try to sell or spin off HP's personal computer division showed that many investors aren't sure what to make of his decision-making. The move was widely praised and vilified at the same time. Analysts cheered HP's efforts to exit parts of the computer hardware business that are barely profitable. But they assailed Apotheker's approach, which was to waffle about whether HP would actually shed the business or keep it after an auction to gauge buyers' interest. The equivocation has already done serious harm to the businesses' value, analysts said.

HP's board is reconsidering a spinoff or sale of the PC division. According to Bloomberg News, some board members think the plan wasn't thoroughly thought out.

Brian White, an analyst with Ticonderoga Securities, floated the idea that HP may not have had Apotheker in mind for the long term anyway. In a research note Wednesday, White wrote that he wouldn't be surprised if Apotheker all along was the "fall guy," hired to take the hit for the ugly work of restructuring.

White said he wouldn't be surprised if HP brings in a new CEO, "as we have always thought that Leo was placed in the role on a short-term basis to take the fall for the company's under investment under the previous CEO," White wrote. "At the same time, we believe a new CEO could begin to build credibility for HP and join the company after quite a bit of damage has already been done."

An HP spokesman declined to comment. The news was earlier reported by Bloomberg News and AllThingsD.com.

HP shares rose $1.65, or 7.3 percent on Wednesday, to $24.12. HP's market value, which had been $108 billion before Hurd's exit in August of 2010, now stands at $48 billion. That makes HP's biggest rival, IBM Corp., four times bigger by that measure and Hurd's new employer, Oracle Corp., three times bigger.

TOKYO ? Japan's defense chief said Tuesday that the country's largest arms contractor has suffered a cyberattack, but that no sensitive information is known to have been lost.

Defense Minister Yasuo Ichikawa urged Mitsubishi Heavy Industry Ltd. to strengthen its data security systems.

"We are not aware of any important data having leaked to the outside," Ichikawa said.

The company makes ships, submarines, missile parts and other weapons for Japan's military.

Mitsubishi Heavy said it had been attacked in August with viruses apparently programmed to breach its computers and servers to gain unauthorized access to protected data. It did not say why it waited until this week to disclose the attack.

"We discovered that there had been a possible leak of system information such as network addresses from some of the computers at the company," it said in a statement Monday.

It said it has been working with police and independent experts to contain the damage.

The attack involved more than 80 servers and computers at 11 of the company's facilities related to nuclear power, missiles and submarines, the Nikkei business newspaper said Tuesday.

Attackers allegedly used simplified Chinese characters ? the writing system used in mainland China ? to remotely control the infected computers, and authorities are investigating the case as suspected spying, the nationwide Yomiuri newspaper reported Tuesday, quoting unidentified sources.

In Beijing, Chinese Foreign Ministry spokesman Hong Lei denied China was involved. "Criticism that China initiated a cyberattack is not only groundless, it goes against development of international cooperation on cybersecurity," Hong told a daily briefing.

An annual U.S. assessment of China's military in August said a number of computer systems, including U.S. networks, were the target of intrusions in 2010 that appeared to originate in China. The breaches were aimed at stealing data, but also exhibited the kinds of skills needed for more destructive network attacks, it said.

Another Japanese defense contractor, shipmaker IHI Corp., also reportedly came under cyberattack in recent months, receiving a number of emails with virus-loaded attachments.

Separately, Japan's National Police Agency said Tuesday that online messages were circulated last week in China calling for attacks on Japanese government websites ahead of the 80th anniversary of the Sept. 18 "Mukden Incident."

TOPEKA, Kan. (AP) ? A Kansas doctor?s medical records don?t show adequate exams of young patients that she diagnosed with mental health problems and referred elsewhere for late-term abortions, a Georgetown University professor testified Tuesday during a disciplinary hearing.

A complaint before the State Board of Healing Arts accuses Dr. Ann Kristin Neuhaus of negligence in conducting her exams. Board attorneys presenting the case against Neuhaus to a hearing officer called Dr. Liza Gold, a clinical professor of psychiatry at Georgetown?s Medical Center, as an expert witness.

The complaint deals with Neuhaus? care for 11 patients ? ages 10 to 18 ? all at least 25 weeks pregnant, who received abortions from the late Dr. George Tiller?s clinic in Wichita from July to November 2003. Kansas law then permitted the abortion of a viable fetus starting at the 22nd week of pregnancy only if the woman faced death or ?substantial and irreversible? harm to ?a major bodily function,? which included mental health. The law was tightened this year and now has no mental health exception.

Neuhaus provided second opinions Tiller needed under the law, diagnosing the young patients with anxiety disorder, acute stress disorder and single-episode major depression. On Tuesday, board attorneys had Gold go through Neuhaus? records for nine of the 11 patients.

Gold testified that Neuhaus used a computer program, ?PsychManager Lite,? to create reports with only ?generic? statements about patients? conditions, usually minutes after Neuhaus finished compiling answers to a series of yes or no questions. Gold repeatedly said that based on the documents, Neuhaus failed to meet accepted standards of care and her records didn?t explain to others how she arrived at her diagnoses.

Gold noted that in the cases of two young patients, Neuhaus? records said they could be suicidal enough to legally could be committed for treatment, but there was no indication she sought to intervene immediately in what could be emergencies.

?There?s a lot of information that should be there that isn?t,? Gold testified.

One of Neuhaus? attorneys, Robert Eye, objected unsuccessfully to Gold being designated as an expert witness, arguing she Gold doesn?t have enough expertise with abortion. Eye said during a break in the hearing Tuesday that Gold?s testimony also was flawed because it was based on only a review of records.

?She?s not interviewed Dr. Neuhaus, nor has she interviewed any of these patients,? Eye said.

Anti-abortion groups have pushed the board to discipline Neuhaus since at least 2000. The hearing resulted from a 2006 complaint filed by Operation Rescue.

Tiller was one of a few U.S. physicians performing late-term procedures when a man professing strong anti-abortion views shot him to death in May 2009. The doctor had been acquitted two months earlier of misdemeanor criminal charges that, in relying on Neuhaus for referrals, he wasn?t getting the independent second medical opinion as state law required.

The hearing officer will issue an order recommending whether Neuhaus, from Nortonville, a small town about 30 miles north of Lawrence, should face sanctions. The 15-member board, mostly doctors, will make the final decision and has the power to revoke her Kansas license.

Gold said repeatedly that Neuhaus? patient records didn?t contain information about clients? lives and histories needed to support diagnoses of mental health problems. Some files contained as few as five pages, she testified.

One case involved a 10-year-old rape and incest victim from California who had a late-term abortion at Tiller?s clinic in July 2003. Gold questioned whether Neuhaus met accepted standards of care because Neuhaus didn?t refer the girl to a specialist. But, Gold said, even assuming Neuhaus had the proper training, her reports contain too little data about the patient and contradictory information about whether the girl was suicidal.

?This kind of evaluation would take, even for a specialist, hours and hours and require input from other caregivers,? Gold testified. ?There is no indication that kind of labor-intensive process occurred.?

Eye said Gold?s testimony didn?t adequately consider information shared by Tiller?s clinic.

?Dr. Neuhaus had an obligation to do an independent medical review, true, but there?s nothing to say that it?s not legitimate to rely on the work of others who are providing information,? Eye said. ?That?s common in a doctor?s office.?

But Gold said another person?s evaluation of a patient shouldn?t have served as the basis for Neuhaus? diagnosis when she had the opportunity to see the patient herself.

?I still have to evaluate the patient because what he or she saw last week might not be what I see this week,? Gold said.
