Massachusetts chemist pleads not guilty in crime lab scandal

BOSTON (Reuters) - A former Massachusetts crime lab chemist accused of falsifying evidence tied to as many as 34,000 cases pleaded not guilty to obstruction of justice charges on Wednesday.

Prosecutors allege Annie Dookhan, 35, tampered with drug evidence and faked test results at the Hinton State Laboratory Institute in Boston, where she had worked for nine years analyzing drug samples submitted by law enforcement across the state.

Dookhan is accused, among other things, of altering substances in vials to cover up her practice of visually identifying samples without doing the proper chemical testing.

Dookhan was arrested in September and subsequently charged with tampering with evidence, obstruction of justice, perjury, and falsely claiming to have an advanced degree in chemistry. Prosecutors charge she got the job by falsely claiming she had a master's degree from the University of Massachusetts.

Investigators have said they identified some 10,000 people convicted or accused of crimes based on evidence she had handled at the Hinton lab, which is temporarily closed.

State officials say 252 people had been released from prison pending new trials as a result of the investigation, as of January 4.

Dookhan pleaded not guilty to five obstruction of justice charges during an arraignment on Wednesday at Plymouth County Superior Court's criminal division in Brockton, Massachusetts. A separate arraignment was set for Wednesday afternoon at another courthouse.

Dookhan was indicted by a grand jury on 27 charges in mid-December.

Authorities believe she gathered samples from different cases that appeared to contain the same substance, but tested only a few of them. She allegedly tampered with vials undergoing subsequent testing to make sure they were consistent with her initial findings, they have charged.

The release of prisoners has created a headache for state and local officials. Boston Mayor Thomas Menino in November requested $15 million in state aid to help the city cope with additional police and shelter expenses that resulted from the release.

Dookhan, who told officials according to a police report that she "screwed up big time," has said that no one else at the lab knew what she had done and that she was just trying to get more work done.

This month, a second state crime lab chemist who worked at the Amherst lab in western Massachusetts was charged with tampering with evidence and drug possession after being accused of stealing already-tested illegal drugs for her own use.

Boy snatched from school bus, held hostage in bunker

By Alastair Jamieson, Staff writer, NBC News

WSFA.com

Multiple local and county officials were on the scene of the shootng Tuesday, Jan. 29, near Midland City, Ala.

A boy was being held hostage in a bunker in Alabama early Wednesday by a man who seized him from a school bus after fatally shooting the driver, witnesses and police said.

Authorities were negotiating with the man overnight at the scene near Midland City.

The driver of the bus died from gunshot wounds on Tuesday afternoon and the suspect was not in custody, according to the Dale County Sheriff's Department.

Witnesses told NBC station WSFA that the suspect boarded the bus and ordered some children off before grabbing a boy aged 5 or 6, shooting the driver and fleeing towards his nearby home.

Michael Senn, who is minister of a nearby church, told the station that he spoke to several children on the bus, including a girl who said the driver was shot four times. He described one 13-year-old as "really traumatized."

Mike Creel, who said he was the suspect?s neighbor, told the station the suspect had hidden ?in his homemade bomb shelter.? However, officials described it as a storm shelter.

Creel said the suspect has lived on the property for around two years and that the underground shelter was ?one of the first things he started building."

The station said police believed the child was "OK" and that police were conducting negotiations with the suspect using a plastic pipe.

Other neighbors identified the suspect to the local newspaper, the Dothan Eagle, as a 67-year-old man. NBC News was unable to confirm this early Wednesday.

Lisa Harden, of the Dale County School District Office, said the bus was on a route that served all local schools, and had children of all ages on board.

Dale County and Ozark city schools will be closed Wednesday, officials said.

"Due to the sensitive nature of the open and ongoing incident, limited details are being released at this time," Dale County Sheriff's Department said in a 10 p.m. local time (11 pm. ET) Tuesday update.

The update added that nearby residents had been evacuated "as a precautionary measure as public safety remains paramount in this situation."

How Rubio Reformed His Immigration Thinking

Arizona Sen. John McCain partnered with liberal Democrat Ted Kennedy in 2005 to offer illegal immigrants a pathway to citizenship, then allied with border security hardliners during a tough 2010 Republican primary. "Complete the danged fence," McCain cracked in a widely publicized television spot.

Loading feed...

Less well known is the equally dramatic pivot by Marco Rubio, from 2010 candidate who dismissed McCain?s proposal as ?amnesty,? to U.S. senator who on Monday championed reforms McCain said had ?very little difference? from his previous plan, which became the blueprint for failed legislation in 2006 and 2007.

During a March 28, 2010 Fox News debate against then-Gov. Charlie Crist, Rubio said: ?He would have voted for the McCain plan. I think that plan is wrong, and the reason I think it?s wrong is that if you grant amnesty, as the governor proposes that we do, in any form, whether it's back of the line or so forth, you will destroy any chance we will ever have of having a legal immigration system that works here in America.?

In a CNN debate on Oct 24, 2010, moderator Candy Crowley asked, ?So your plan is that you're going to close the borders, get the electronic system, fix the legal system, and then do what?" Rubio responded: ?And then you'll have a legal immigration system that works. And you'll have people in this country that are without documents that will be able to return to the -- will be able to leave this country, return to their homeland, and try to re-enter through our system that now functions, a system that makes sense?Earned path to citizenship is basically code for amnesty.?

The legislation Rubio backed Monday requires illegal immigrants to pass a criminal background check, hold down a job, pay fines and back taxes, learn English, and go to the back of the line ? just like previous proposals. ?It is not going to be an easy process, but it's certainly going to be a fair one and a humane one and one that speaks to our nation's legacy, both as a nation of laws, but also as a nation of immigrants,? Rubio said at the Capitol Hill press conference. As details of the new legislation are still emerging, it?s unclear what Rubio sees as the differences between it and past proposals.

What is apparent is that the turnaround by the potential presidential contender reflects a changing political calculus. Rubio went from longshot to rock star in the tea party-dominated 2010 campaign in part by running to the right of the moderate governor. Now, after two years of burnishing his conservative record in the Senate, immigration reform offers one of the nation?s most prominent Hispanic Republicans an opportunity to show leadership and substance as he positions himself for a possible White House bid.

?He took a right turn on immigration but he?s slowly coming back to where I think he?s naturally oriented,? said Marshall Fitz, direction of immigration policy at the liberal Center for American Progress. ?He understands he has to be a player on this issue.?

As Rubio's star power and skills at framing the immigration debate begin to lure conservatives to the table, the potential for a breakthrough in Washington is already overshadowing his previous policy shifts.

As a state lawmaker in 2003 and 2004, he co-sponsored bills to give college tuition breaks to illegal immigrants. As Florida House Speaker in 2008, half a dozen bills that aimed to crack down on illegal immigrants fizzled on his watch.

But during the 2010 campaign, Rubio towed the anti-amnesty line demanded by the conservative base of his party. He even argued the U.S. census should count ?only legal citizens? because including illegal immigrants would ?actually incentivize politicians to perpetuate our broken immigration system by rewarding states with large illegal immigrant populations with a louder voice in Washington.? The statement drew rebukes from fellow Republicans and led Rubio to clarify that only legal residents should be counted.

In Oct. 2011, when Texas Gov. Rick Perry?s advocacy for in-state tuition for illegal immigrants in his own state had, in part, cost him the lead in the Republican primary,?Rubio retreated from his previous support for such tuition breaks. ?As a general rule, people in the United States who are here without documentation should not benefit from programs like in-state tuition,?? Rubio said at the time.

Rubio?s approach changed again a few months later when he began touting legal status for illegal immigrants who attend college or join the military, and?he criticized members of his own party for using ?harsh and intolerable? rhetoric. ?He put his neck out there,? said Jennifer Korn, executive director of the center-right Hispanic Leadership Network. ?In watching him and seeing how he operates, I think he does things because he believes in them, not because they are politically expedient.?

But at the same time he was promoting an alternative to the DREAM Act, Rubio filed a bill that would make it harder for undocumented workers to claim a child tax credit.

?Frankly it was perplexing,? Fitz said. ?I don?t know if it was an effort to inoculate him from attacks on the right, but it didn?t make any sense to take food off the table from U.S. citizen kids in the name of trying to make life harder for their undocumented parents.?

Rubio never produced DREAM Act legislation, and his level of engagement wasn?t completely clear until two weeks ago, when he outlined his principles in?an interview with? The Wall Street Journal: tighter border security, temporary work visas for low-skilled workers, more visas for high-skilled workers and an arduous way for illegal immigrants to earn citizenship. That?s roughly the same McCain plan Rubio once said he opposed. ?Yet immigration advocates who have criticized Rubio's policy shifts in the past are holding back as his presence gives new momentum to their longtime goals.

"Politicians do change their positions, for better or worse," said Arturo Vargas, executive director of the National Association of Latino Elected and Appointed Officials. "It happened with John McCain, who moved to the right in an election and is now back in the mix, and it's happened with Rubio. People take their journey -- what I am more concerned about is their destination."

Nokia Lumia 900 for AT&T may get Windows Phone 7.8 on January 30th

Nokia Lumia 900 on AT&T may get Windows Phone 78 on January 30th

There's been hints of a Windows Phone 7.8 update looming for the AT&T-spec Lumia 900, but little sign of a real timetable. As it turns out, owners hoping to move beyond 7.5 might be satisfied very quickly. Engadget has obtained an AT&T memo that claims the upgrade is rolling out on January 30th -- as in, tomorrow. We don't see any tweaks mentioned beyond what Microsoft itself said last year, although any update would most likely include Nokia-specific extras on top of the official package. We've reached out to AT&T, Microsoft and Nokia, and we'll let you know if they provide tangible details. Whatever their answers, we'll know the truth before long.

10 Ways to Celebrate Family Literacy Day | clubmom

Family Literacy DayFamily Literacy Day is January 27, a day that recognizes the importance of engaging in literacy activities as a family. Taking just 15 minutes a day to get involved in learning activities with your child goes a long way to improving her literacy skills. So in honour of Family Literacy Day, here are (in no particular order) 10 ways to celebrate family literacy every day.

1. Throw a Family Games Night

Board games offer great opportunities to practice reading, writing and counting as well as taking turns. With so many family games out there, many with junior versions for the younger set, it?s easy to find something everyone will enjoy.

2. Cuddle Up and Read Together

We all know the importance of reading to our babes and preschoolers, but don?t stop reading to them once they learn to read for themselves. Choose a book with a great story, one you?ll enjoy as much as your child. Your child will enjoy hearing a story that might be above her reading level. You?ll enjoy the quiet closeness.

3. Visit Your Local Library

Have you been to the library lately? It?s not the same as it was when we were kids. The library is buzzing with activity, including programming for readers of all ages. Check the library?s website for programming available at your local branch.

4. Host a Popcorn Book Club

This one comes courtesy of my sister. Here?s how it works: Gather the family in a comfy place and take turns talking about a book they?re reading or recently read. Everyone knows book clubs are as much about food as they are about books, so be sure to have some popcorn and other tasty snacks at the ready.

5. Cook Together

Invite the little ones into the kitchen and cook something up together. Following a recipe involves reading, counting and measuring. If your kids are real foodies, why not make up your own recipes and create a family cookbook.

6. You?ve Got Mail

Send postcards or greeting cards to friends or family. Everyone likes to get mail, especially kids. It?s especially nice when it comes with a warm and fuzzy message.

7. Check Out an Independent Bookstore

Indie bookstores, particularly children?s bookstores, are wondrous places. And the good folks who work there are oh so knowledgeable. They?ll set you right up with something you?ll enjoy reading. Many children?s bookstores also carry a good selection of adult books.

8. Plan Your Next Family Vacation Together

Go online or gather some travel books and research destinations, accommodations and itineraries together. Work together to map out your trip. Make lists of what you?ll need. Not only is this a great literacy exercise, it also helps ensure everyone will enjoy the next vacation.

9. Head to the Grocery Store

There is a lot of literacy involved in getting the groceries done. At home, the kids can help you come up with the grocery list. The little ones can cut pictures of what you need from the weekly grocery flyers and the older ones can help you sort the items into categories and map out your route in the store. In the store, the kids can help you count items, read labels and compare prices. The bonus: you?ll be done so much faster with the extra help.

10. Get Caught Reading

Be sure to build time into your day when you can read for yourself. Doesn?t matter if it?s the newspaper, a magazine or a book, modeling reading as an enjoyable part of your day is one of the most important things you can do to raise life-long readers.

Get Better Gas Mileage and Fuel Economy with These DIY Car Care Tips

Get Better Gas Mileage and Fuel Economy with These DIY Car Care TipsWhy spend more at the gas pump when you can easily spend less? The team at The Family Handyman shares this list of DIY tricks for a noticeable difference in your fuel costs. The savings are based on driving 20,000 miles per year, in a car that gets 20 mpg, with gasoline priced at $3.75 a gallon.

Save $900 by Keeping Your Tires at the Right Pressure

Surveys show that 60 percent of the vehicles on the road have tires that are underinflated by at least 30 percent. That's at least 9 psi below the manufacturer's recommended pressure. That can cost you almost 7 percent in wasted fuel ($245 per year, or 24? per gallon). Plus, low air pressure causes premature tire wear, and that can cost almost $300 over the life of the tires. For best results, check your tire's air pressure with a digital pressure gauge (about $10 at any auto parts store) and fill to the recommended pressure shown on the decal inside the driver's door or on the driver's door pillar.

Change Spark Plugs Before They're Due

If your 100,000-mile spark plugs have 80,000 miles on them, they're 80 percent worn. Misfires and incomplete combustion occur more frequently during that last 20,000 miles, costing you almost $562.50 in wasted fuel. You have to replace your spark plugs anyway, so do it early and pocket the savings. Even if you have to replace the plugs one extra time over the life of your car, you'll still come out way ahead. And don't automatically assume your plugs are good for 100,000 miles. Many four-cylinder engines require new spark plugs at either 30,000 or 60,000-mile intervals.

Save $350 by Changing Your Air Filter Early and Often

Your engine sucks in 14 million gallons of air through the filter every year. On older vehicles (pre-1999) a dirty air filter increases fuel usage by almost 10 percent ($350 per year, or 35? per gallon). On newer vehicles, the computer is smart enough to detect the lower airflow, and it cuts back on fuel. So your engine will lack power and pick-up. Check the filter when you change your oil and replace it at least once a year, or more if you drive in dirty, dusty conditions.

Get Better Gas Mileage and Fuel Economy with These DIY Car Care Tips

Save $177.50 by Keeping Your Car Aligned

If your tires are bowed out of alignment by just .017 in., it's the equivalent of dragging your tire sideways for 102 miles for every 20,000 you drive. That'll cost you $187.50 a year in wasted gas. It will wear your tires faster, costing you $70 more a year.

Here's an easy way to check your alignment without taking your car in to the shop. Buy a tread depth gauge ($2) and measure the tread depth on both edges of each tire (rear tires too). If one side of the tire is worn more than the other, your car needs to be aligned. An alignment costs about $80, so you'll still save $177.50 the first year alone.

Lead Foot = Lead Wallet

Hard acceleration in stop-and-go driving costs you 20 percent in gas mileage. If you live your life in rush hour traffic and like to put the pedal to the metal, spend all your extra time at the next stoplight figuring out how you could have spent the $750 a year you're wasting (70? per gallon).

Get Better Gas Mileage and Fuel Economy with These DIY Car Care Tips

Replace a Broken or Missing Spoiler

The plastic air dam (aka "spoiler") that's broken or missing wasn't just for a sporty look. If your car had an air dam, driving without it or with a damaged one can reduce your gas mileage. The air dam literally "dams off" airflow to the undercarriage of your car, forcing the air up and over the hood. That helps your car cut through the air with less drag. It also increases airflow to the A/C condenser and radiator, reducing the load on your car's electrical system. Contact a junkyard or visit certifit.com to get a replacement air dam.

Speed Kills Your Gas Mileage and Your Wallet

Yes, you've heard it before, but how about some real world numbers to drive the point home? Aerodynamic drag is a minor concern in city driving, but it really kills your gas mileage at speeds over 55 mph. In fact, increasing your speed to 65 increases drag by 36 percent! If you do a lot of highway driving, getting to your destination a few minutes early could cost you an extra $500 to $600 a year. Keep it closer to 55 mph and use your cruise control. It will pay off.

Replace Your Oxygen Sensor Before the Light Goes On

Oxygen sensors monitor the efficiency of combustion by tracking the amount of oxygen remaining in the exhaust. But they degrade over time and that can cost you up to 15 percent in gas mileage. When they fail, the computer lights up your "service engine soon" light, forcing you to incur an $80 diagnostic fee. On pre-1996 vehicles, replace your oxygen sensor every 60,000 miles to keep your mileage at its peak. On 1996 and newer vehicles, replace the sensors every 100,000 miles. Oxygen sensors cost about $60 each. Some vehicles have as many as four, but the sensors installed behind the catalytic converter rarely fail.

Evolution of Business Presentation Technology: Conversation with ...

Jim ConfaloneJim Confalone is a partner and creative director with ProPoint Graphics and is responsible for production operations. With a background in fine arts, he got his start as a designer leading the graphics department at a boutique management consulting firm in Boston, Massachussetts. Prior to ProPoint, he also worked as a web, Flash, and graphic designer in the New York area. Mr. Confalone holds an MFA with Honors in Painting and Printmaking from the Rhode Island School of Design and a BA Summa Cum Laude in Fine Arts from Amherst College.

In this conversation, Jim talks about ProPoint's Evolution of Business Presentation Technology graphic.

Geetesh: Your Evolution of Business Presentation Technology infographic goes back 2 centuries ? how has presenting been the same during these two hundred years, and how has it been different?

Jim: The purpose of presentations hasn't changed -- they are still intended to inform, educate and persuade. What also hasn't changed is presenters' recognition of the importance of visuals to help them deliver powerful, engaging presentation, and also to help them communicate their message effectively.

Full graphic can be seen here.

Whether using a blackboard, magic lantern, or transparency projector, until recently the purpose of the delivery method has generally been to illustrate on large scale the core message of a presentation. What's really fascinating are the new opportunities afforded by the growth of multimedia, online and interactive tools. Instead of just throwing something on the wall, you can now directly involve your audience on a whole new level with things like supporting video or animation, online links to external sources, or real-time interactive polling. And whenever you can make a direct connection to your audience your job becomes a whole lot easier.

Geetesh: Tell us about this infographic ? why you created this, and was it fun creating this graphic?

Jim: Our interest in creating this infographic spawned from our desire to explore how we have arrived to where we are today. Presentations have become such an important business communication tool, we have so many options now, and have easier tools to use and access to them. We wanted to have a look back to see how our predecessors achieved their presentation goals.

Full graphic can be seen here.

We had a great time researching and putting the infographic together, especially for those of us who have actually had experience with some of these technologies that could easily be considered antiques. It's always fun to look back and appreciate how far we've come.

Geetesh: Although presentation technology has evolved to such a large extent, memory retention and concentration from the audience has reduced. What can presenters do to involve their audiences more?

Jim: Use engaging visuals that holds the interest of the audience and helps you communicate your message. Avoid using too much text -- if the audience has to read your presentation they will become bored and distracted. Limiting text on your slides will prevent you from using them as your script -- reading slides disengages you from the audience. Consider using multimedia to break up your presentation and show the audience something fresh to re-spark interest. Also, consider making your presentation interactive by having asking questions, using props (professional and relevant) and surveys.

McCain: Immigration plan to have pathway to citizenship

Two senators at the center of negotiations over comprehensive immigration reform, Sen. John McCain (R-Ariz.) and Sen. Bob Menendez (D-N.J.) said on Sunday that a pathway to citizenship is an essential component of a comprehensive reform bill.

"That has to be also part of it," McCain told ABC News' Martha Raddatz on "This Week" when asked whether a pathway to citizenship would be a component of reform. "There's a new appreciation on both sides of the aisle including, maybe more importantly on the Republican side of the aisle, that we have to enact comprehensive immigration reform."

Like "This Week" on Facebook here. You can also follow the show on Twitter here.

McCain said that a small group of Senators will release the principles of a comprehensive, not "piecemeal," reform bill this week.

"I'm very pleased with the progress," McCain said. "It's not that much different from what we tried to do in 2007."

Read a full transcript of the interview with Sens. McCain and Menendez HERE.

Menendez, who met with President Obama on Friday along with other members of the Congressional Hispanic Caucus leadership, said that the president expressed his full commitment to reform.

"The president made it very clear in that discussion that this was a top legislative priority for him in this session of the Congress and that he expects to work with all of us in an effort to achieve that goal and he's fully committed to it."

He added that a pathway to "earned legalization" is an "essential element" of an immigration reform bill.

"First, Americans support it in poll after poll. Secondly, Latino voters expect it. Thirdly Democrats want it. And fourth Republicans need it," Menendez said.

McCain added that he believes Obama's use of the presidential podium on behalf of immigration reform at an event in Las Vegas planned for Tuesday will aid efforts to pass a bill.

"I think it helps," McCain said. "I think its important that we all work together on this."

"Believe it or not, I see a glimmer of bipartisanship out there," he added.

No. 1 Baylor women beat No. 20 Oklahoma 82-65

WACO, Texas (AP) ? Brittney Griner now has the record she has always wanted.

How about a block party for the two-time All-American from Baylor who already holds the NCAA women's record with 11 dunks and is a three-point play from becoming the Big 12's career scoring leader.

Griner set the NCAA career record for blocked shots, getting the record-tying and record-setting blocks by swatting away a pair of shots by Oklahoma's Aaryn Ellenberg, as the top-ranked Lady Bears won 82-65 Saturday for their 50th consecutive win at home.

"Definitely happy I got that. Now I'm going to try to set it higher," the 6-foot-8 Griner said. "Blocked shots keep the other team from scoring, that's just how I look at it. Blocked shots kind of remind me when I played volleyball, I used to love to spike. ... That's why I like (blocks) the most."

With eight in the game, Griner has 665 career blocks, two more than Louella Tomlinson had for St. Mary's in California (2007-11).

"As good as she is on the offensive end, where she really changes games is on the defensive end," Oklahoma coach Sherri Coale said. "She obviously has the wingspan and the athleticism, but she also has that ornate sense that I think all great shot blockers have knowing when to go get it."

By fouling out for only the second time in her 131 career games, Griner missed a chance to also break the Big 12 scoring record before the Lady Bears (18-1, 8-0 Big 12) play their next two games on the road. Her 2,833 career points are two shy of matching Oklahoma State's Andrea Riley's (2007-10).

Griner finished with 15 points to lead six players in double figures for Baylor, which has won 36 consecutive Big 12 regular-season and tournament games since a loss to Oklahoma in the conference tournament three years ago.

Odyssey Sims had 12 points and 10 assists while Destiny Williams had 11 points and 10 rebounds.

Ellenberg had 33 points for the Sooners (15-4, 5-2). Joanna McFarland had 12 points and 16 rebounds.

Griner got her 663rd career block with just under 13 minutes left. A similar play with 10:25 remaining was Griner's seventh of the game and broke Tomlinson's record.

With 5:14 to go, Griner was called for a foul on another shot by Ellenberg. It was the first time she fouled out since the second game of her freshman season.

"Disappointed I fouled out at the end of the game," Griner said.

That came less than a minute after Griner was called for a charge against McFarland for the second time in the game.

In a 30-second span of the first half, McFarland drew charges against Griner and Jordan Madden and hit a 3-pointer in between.

"It's not like a fear. You've just got to go in and bow up, like if she goes hard at me, I've got to go hard back," McFarland said. "It's a mutual thing."

McFarland's long-range shot pulled the Sooners within 26-21, but they never got closer.

The Sooners made 11 of 26 3-pointers, but were just 9 of 46 inside the arc.

"I'm really proud of our guys, I thought we competed and fought every step of the way, and did some really, really good things and attacked them, and went after them, and shot pretty well from 3," Coale said. "Obviously did not shoot well from 2, but there's a big reason for that. Her number's 42 (Griner)."

Oklahoma won the opening tip and Ellenberg immediately hit a 3-pointer. The Sooners were up 10-8 when Ellenberg hit another 3 from the top left of the key 4 minutes later.

Baylor then scored 14 points in a row over the next 5 minutes and took the lead for good. The spurt ended with consecutive baskets by Brooklyn Pope, who finished with 10 points like Kimetria Hayden and Jordan Madden.

Even after shooting 60 percent from the field (35 of 58) and having six players in double figures against the Big 12's second-place team, there were still things for Baylor coach Kim Mulkey to emphasize to her team.

"You have to evaluate yourself and say if you shot like that and had that many players in double figures, why did you only win by 17?," Mulkey said. "Well then it goes back to two things. One, missed free throws, they make free throws. We missed 14 free throws, that's unacceptable. Then they made a lot of 3's."

Not nearly enough though.

New California rules protect employees - Business Management Daily

The start of the New Year saw the enactment of several new California employment laws, including one that requires accommodation of employees? religious dress and grooming needs.

AB1964 requires employers to ac??com?modate an employee?s or job applicant?s ?religious dress? or ?grooming practices.? Religious dress includes the wearing or carrying of religious clothing, head or face coverings, jewelry or other artifacts. Religious grooming practices include those concerning head, facial or body hair. The practices must be part of the individual?s observance of his or her religious creed.

Employers may not segregate or reassign individuals because of their religious dress or grooming practices.

State government codes 12926 and 12940 regulate implementation of the law.

Court Bans Operators of Timeshare Scheme From the Timeshare ...

FTC logoFTC Alleged that Defendants Falsely Claimed They Had Buyers Lined Up for Consumers? Properties

Washington, DC (January 25, 2013) ? As the result of a Federal Trade Commission (FTC) action, the operators of a scheme that allegedly deceived consumers who were trying to sell their timeshare properties are permanently banned from the timeshare resale business, and from all telemarketing, and one of them has been ordered to pay more than $6 million. The FTC?s case against National Solutions LLC is part of its ongoing effort to stop timeshare scams and protect consumers from fraud and deception in the marketplace.

In July 2011, the FTC charged Leandro Velazquez, Edgar Gonzalez, Samuel Velazquez, Joel Velazquez, and others with violating the FTC Act and the FTC?s Telemarketing Sales Rule by misrepresenting that they had buyers willing to pay a specific price for consumers? timeshare properties, that they would refund their up-front fee when the property was sold, and that the FTC would review and approve proposed sales. At the FTC?s request, the court halted the operation, pending litigation.

According to the FTC, the defendants charged consumers up to $3,150 as an ?earnest money deposit? to commit them to the sale or for sale-related expenses, and promised to refund the money when the sale closed.? Customers often were not contacted again, their properties were never sold, and their refund demands were ignored or denied.? Contrary to the defendants? alleged assertions, the FTC does not review or approve timeshare sales.

The court entered a final judgment against?Leandro Velazquez?and approved settlement agreements with?Edgar Gonzalez,Samuel Velazquez, and?Joel Velazquez. In addition to banning Leandro Velazquez from all telemarketing and from participating in the timeshare resale business, the court order prohibits him from collecting money from customers, selling or otherwise benefitting from consumers? personal information, failing to properly dispose of customer information, and misrepresenting material facts about any goods or services.? The order also imposes a judgment of almost $6.3 million against Leandro Velazquez.? The three settlement agreements include the same bans and impose the same monetary judgment, which is suspended based on their inability to pay.? The full judgment will become due immediately if those defendants are found to have misrepresented their financial condition.

Litigation continues against and Kiomary Cruz and the corporate defendants.

To avoid pitfalls when selling a timeshare unit, read the FTC?s?Timeshares and Vacation Plans.

The Commission vote, including Commissioner J. Thomas Rosch, approving the proposed settlement orders was 5-0.? The final order against Leandro Velazquez and the settlement orders with other defendants were entered by the U.S. District Court for the Middle District of Florida, Orlando Division.

NOTE:? Settlement orders are for settlement purposes only and do not constitute an admission by the defendants that the law has been violated.? Settlement orders have the force of law when approved and signed by a District Court judge.

Facebook Rolls Out Ad Conversion Measurement Globally So That Marketers Know When One Of Their Ads Did The Trick

facebook-ads-logo DoneFacebook today took one more step in making its advertising more accountable for media buyers: it has now rolled out a conversion measurement system ?across its global footprint. Aimed at direct marketers, the optimization and conversion toll was first announced back in November; now it's available globally, and can be used?on all Facebook ads and sponsored stories, the company says, as well as in combination with any other targeting services. And, in a sign of increasing cross-platform marketing,?Facebook says that its conversion measurement tool is ?can report when a user views an ad on one platform, like mobile, but then converts on another, like a PC. It's the only tool so far that can do this -- but as Facebook continues to expand its advertising business, it's not likely to be the last.

Emergency room redux for many patients after hospitalization

Jan. 22, 2013 ? After a hospitalization, patients face many challenges as they transition home. A new study of this vulnerable period published by Yale School of Medicine researchers in JAMA found that a substantial number of patients return to the emergency department soon after leaving the hospital, and, while such patients are not usually readmitted, the study raises concerns that many more patients require acute medical care after hospital discharge than previously recognized.

A hospital's readmission rate is a marker of hospital quality of care and the success of patient transitions to outpatient care. However, hospital readmission rates may not tell the whole story.

"It's frustrating to see people ending up back in the emergency room so soon after leaving the hospital," said the study's lead author Dr. Anita Vashi, a Robert Wood Johnson clinical scholar at Yale. "It makes me wonder about the cause. Are we not educating them well enough about how to safely transition home? Or do we not have capacity in the system for their care team to coordinate follow-up care if they have a complication? Either way, care that is fragmented in this manner can lead to conflicting recommendations, medication errors, distress, and higher costs."

Vashi and her team studied over five million patients who were discharged from acute care hospitals across three states -- California, Florida, and Nebraska -- in 2008-2009. Nearly 18% of hospitalized patients returned to either the emergency room or were readmitted within 30 days following discharge. Medicare beneficiaries had even higher rates. Visits to the emergency room, which are not currently measured by hospital readmission rates, accounted for nearly 40% of all visits back to the hospital within 30 days after discharge.

"The big question is how many of these emergency room visits could have been avoided by tightening up our healthcare system, and ensuring close collaboration and communication between patients and their health providers inside and outside the hospital," said senior author Dr. Cary Gross, associate professor of internal medicine at Yale School of Medicine and director of the Cancer Outcomes, Public Policy, and Effectiveness Research (COPPER) center at Yale. "Future work should focus on identifying how to decrease the need for patients to seek emergency room care right after they leave the hospital."

Conditions with the highest emergency room rates were related to mental health, drug and alcohol abuse, and prostate issues. "High and varying rates of emergency room utilization suggest there is potential to improve care coordination and acute care delivery," said Vashi. "If we don't expand our view of post-acute care from readmissions to include emergency room visits, we will severely underestimate patient needs and system resources required to care tor them."

Other study authors include Dr. Justin P. Fox, Dr. Brendan G. Carr, Dr. Gail D'Onofrio, Dr. Jesse M. Pines, and Dr. Joseph S. Ross.

The study was supported by the Robert Wood Johnson Foundation; the National Institute on Aging (Ross); the American Federation for Aging Research through the Paul B. Beeson Career Development Award Program (Ross); and a career development award to Carr K08 AG032886 from the Agency for Healthcare Research and Quality.

North Korea allows tourists to rent phones or SIM cards, but doesn't include internet

North Korea allows tourists to rent phones or SIM cards, but doesn't include internet

North Korea (which recently added Google's Eric Schmidt to its guest book) will begin loosening its restrictions on foreign cellphones, allowing any arrivals to either pick up a rental phone or SIM card from service provider Koryolink. With a rental booth already set up in Pyongyang airport, you'll be able to dial out to numbers abroad, foreign embassies and international hotels. However, the SIMs (priced at around $67) won't allow you to call locals, nor will they offer any internet data -- not even EDGE. Apparently, providing data to the rental SIMs in North Korea wouldn't be a technical issue, but dependent on whether it's granted approval by the DPRK government.

Obama to be sworn in for 2nd term at White House

WASHINGTON (AP) ? Formally embarking on his second term, President Barack Obama will take the oath of office Sunday surrounded by family in an intimate inauguration at the White House, 24 hours before re-enacting the ceremony before an excited crowd of hundreds of thousands outdoors at the Capitol.

The subdued swearing-in is a function of the calendar and the Constitution, which says presidents automatically begin their new terms at noon on Jan. 20. Because that date fell this year on a Sunday ? a day on which inaugural ceremonies historically are not held ? organizers scheduled a second, public swearing-in for Monday.

A crowd of up to 800,000 people is expected to gather on the National Mall to witness that event, which will take place on the Capitol's red, white and blue bunting-draped west front. Supreme Court Chief Justice John Roberts, who famously flubbed the oath of office that Obama took in 2009, will swear the president in both days.

Vice President Joe Biden will also be sworn in Sunday in a small, early morning ceremony at the Naval Observatory, his official residence. Justice Sonia Sotomayor, who was appointed by Obama during his first term, will administer the oath of office to the vice president.

Once the celebrations are over, Obama will plunge into a second-term agenda still dominated by the economy, which slowly churned out of recession during his first four years in office. The president will also seek to cement his legacy with sweeping domestic changes, pledging to achieve both an immigration overhaul and stricter gun laws despite opposition from a divided Congress.

But for one weekend at least, Washington was putting politics aside. Obama called the nation's inaugural traditions "a symbol of how our democracy works and how we peacefully transfer power."

"But it should also be an affirmation that we're all in this together," he said Saturday, as he opened a weekend of inaugural activities at a Washington elementary school.

Only a small group of family members is expected to attend Obama's Sunday swearing-in, including first lady Michelle Obama and daughters Malia and Sasha. A small group of reporters will also be in the room to witness the event.

Roberts will administer the oath of office shortly before noon in the White House Blue Room, an oval space with majestic views of the South Lawn and the Washington Monument. Named for the color of the drapes, upholstery and carpet, the Blue Room is not typically used for ceremonies and instead has primarily been a reception room as well as the site of the only presidential wedding held in the White House, between then-President Grover Cleveland and Frances Folsum in 1886.

Later Sunday, Obama and Biden will speak at an inaugural reception attended by supporters.

But the president will save his most expansive remarks for Monday, when he delivers his second inaugural address to the crowd gathered on the Mall and millions more watching across the country and the world. Obama started working on the speech in early December and was still tinkering with it into the weekend, aides said.

The president's address will set the stage for the policy objectives he seeks to achieve in his second term, including speeding up the economic recovery, passing comprehensive immigration and gun control measures and ending the war in Afghanistan. However, aides said Obama would save the specifics of those agenda items for his Feb. 12 State of the Union address.

The president launched a weekend of inaugural activities Saturday by heading up a National Day of Service. Along with his family, Obama helped hundreds of volunteers spruce up a Washington area elementary school.

His shirt sleeves rolled up, Obama donned a pair of rubber gloves, picked up a paint brush and helped volunteers stain a bookshelf.

Obama added the service event to the inaugural schedule in 2009 and is hoping it becomes a tradition followed for future presidents.

Mrs. Obama, speaking to volunteers Sunday, espoused the importance of giving back in the midst of the weekend of pomp, circumstance and celebration.

"The reason why we're here, why we're standing here, why we're able to celebrate this weekend is because a lot of people worked hard and supported us, and we've got a job to do and this is a symbol of the kind of work that we need to be doing the next four years," Michelle Obama said at Burrville Elementary.

Barcelona Loses To Real Sociedad 3-2: Messi Goal Can't Prolong Catalans' Unbeaten Run (VIDEO)

By Keeghann Sinanan, Goal.com

Barcelona's unbeaten Liga record came to an end after the club went down 3-2 to Real Sociedad in a gripping clash at the Anoeta Stadium on Saturday.

Real Madrid was previously the only side to claim a result against the Catalans with a 2-2 tie last October, but Madrid's exploits were bettered by a heroic showing from the Basque outfit, which fought back from two goals down to clinch victory.

Lionel Messi scored for a record 10th game in a row when he opened the scoring after seven minutes, before Pedro doubled the advantage with 25 minutes on the clock to seemingly put Barca out of sight.

But Sociedad responded five minutes before the break through Chori Castro, and took full advantage of Gerard Pique's second half red card to draw level through a Javier Mascherano own goal shortly after the hour mark.

It seemed destined to end in a draw, but substitute Imanol Agirretxe struck in injury time to clinch a famous victory for the home side, as Barca could now see its lead at the top of the table cut to eight points should Atletico Madrid win against Levante on Sunday.

Cesc Fabregas, Pedro and Pique returned to the starting lineup for Barcelona, with Alex Song, Alexis Sanchez and Javier Mascherano making way after their exertions in the Copa Del Rey against Malaga midweek.

The Catalans were ahead in just the seventh minute. Messi had already drilled a one-on-one wide, and made no mistake at the second time of asking, slotting home superbly from the edge of the box after Barca had pounced on a terrible clearance from Claudio Bravo.

Xabi Prieto came close to responding with a shot that hit the side netting after a clever move from a free kick, but it was Barca which should have scored again after winning the ball inside the Sociedad box, with Pedro unlucky to see his splendid curling effort crack off the far post.

The second goal was always on the cards, and when Dani Alves delivered into the six-yard box after being picked out wonderfully by Xavi, Pedro?s close-range finish was inevitable.

Messi could have made it 3-0 five minutes before halftime after lifting the ball over Bravo, but the ball rolled onto the post before being hacked clear by Mikel Gonzalez.

Instead, within moments, it was 2-1. Chori did well to control a Carlos Vela pass just inside the box, and the Uruguayan picked his spot brilliantly, firing into the bottom corner.

The home fans were back in full voice, and Chori could have equalized with an identical chance seconds after the restart, but this time, Victor Valdes was up to the task and parried the shot away from danger.

Barca was already rattled by the renewed endeavor of Sociedad, and 11 minutes into the second half, the cause was further dented when Pique picked up his second yellow card for a clumsy trip on Vela.

With the Catalans on the ropes, Sociedad struck another decisive blow just after the hour mark. A cross into the area was not dealt with by the defense, and Chori took fortuitous advantage, sending in a shot that Mascherano deflected in despite a touch from Valdes.

The match seemed destined to end with both sides splitting the points, but with the clock moving into injury time, Agirretxe met a Carlos Martinez cross to seal a victory for Sociedad that will surely go down in the team's history.

Editor: Somali journalist shot dead; 1st this year

MOGADISHU, Somalia (AP) ?

Unknown gunmen shot dead a Somali radio producer on Friday, the first journalist to be killed this year, an editor with his Somali radio station said. Eighteen journalists were killed last year, making Somalia one of the most dangerous places in the world for journalists.

Two gunmen shot dead Shabelle producer Abdihared Osman Aden in the Somali capital, Mogadishu, said Mohamed Bashir Hashi, the radio station's editor.

Somali journalists say impunity is fueling the killings. The National Union of Somali Journalists said in November that journalists in almost every region of the country commonly face harassment, blackmail and arbitrary police detention. In addition, criminals are hired to suppress them.

"It's an appalling murder but my message is they cannot silence us from telling the truth," Hashi said.

No action has ever been taken following a case of violence against a Somali journalist, The National Union of Somali Journalist said in a report to mark the International Day to End Impunity on Nov. 23, sponsored by the free expression group, IFEX.

Somalia's government should implement judicial reforms that will aid free and fair trials, as well as provide judicial protection for the media and ensure that police adhere to the law, according to the report titled "Impunity: War on Somali Journalists." The international community can assist Somalia's federal government to put in place effective and functional public law and order, the report said.

Somalia made significant strides politically last year in trying to establish its first functional government to move the country away from its failed-state status.

Somalia had not had a functioning central government since 1991, when warlords overthrew a longtime dictator and turned on each other, plunging the impoverished nation into chaos.

African Union troops have helped to push Islamist extremists called al-Shabab out of all Somalia's major cities, giving the newly elected government a chance to rebuild the country.

The International Federation of Journalist says the al-Qaida-affiliated al-Shabab insurgent group has maimed and killed journalists who do not toe their line.

With Hizbul-Islam, another hardline insurgent group, they have in recent years ratcheted up pressure on radio stations, first and foremost to ascertain their authority on what goes on air and to impose Taliban-type commandments on un-Islamic music, ringtones, film and football, says IFJ.
